PRIVACY POLICY

1. General Provisions
1.1. This Privacy Policy (the "Policy") governs the processing and protection of personal data of users of the website azgeology.kz (the "Website"), operated by Sole Proprietor "A-Z Geology", BIN 901009301107, registered at: Kazakhstan, 010000, Astana, 27A Alikhan Bokeikhan Street, office 25 (the "Operator").
1.2. This Policy has been developed in accordance with:
  • the Law of the Republic of Kazakhstan No. 94-V dated 21 May 2013 "On Personal Data and Their Protection" (the "RK Law"); and
  • the principles of the EU General Data Protection Regulation (Regulation (EU) 2016/679, "GDPR"), applied here as an internationally recognized standard of data protection practice, to the extent relevant to users located outside Kazakhstan.
Where the two frameworks differ, the Operator applies the stricter standard to the relevant user, and RK law governs in all matters of enforcement and jurisdiction, as the Operator is registered and operates in Kazakhstan.
1.3. By using the Website and submitting data through the contact form, the user confirms agreement with this Policy. If the user does not agree with these terms, they should discontinue use of the Website and refrain from submitting personal data.

2. Definitions
  • Personal data — any information relating to an identified or identifiable individual (a "data subject").
  • Processing — any operation performed on personal data, including collection, storage, use, transmission, and deletion.
  • Data subject — a user of the Website who has submitted personal data via the contact form.
  • Controller / Operator — Sole Proprietor "A-Z Geology", which determines the purposes and means of processing.
3. What Data Is Collected
3.1. The Operator collects personal data solely through the Website's contact form. This may include:
  • name (and/or organization, where the user provides context for their inquiry);
  • email address;
  • any other information the user voluntarily includes in the text of their message.
3.2. The Website does not automatically collect data (cookies, analytics, payment data) as of the effective date of this Policy. Should this change, the Policy will be updated with a corresponding section before such collection begins.

4. Purposes of Processing
Personal data is processed solely for the following purposes:
  • responding to user inquiries submitted via the contact form;
  • maintaining contact with the user, including informing them about new training courses and services offered by the Operator, and following up on the user's interest in future courses;
  • any other purpose explicitly agreed with the user at the time of contact.
Personal data is not used for purposes other than those listed above without the data subject's separate consent.

5. Legal Basis for Processing
5.1. Under RK law, processing is based on the consent of the data subject, expressed by completing and submitting the contact form (Article 8(1) of the RK Law).
5.2. Under GDPR, where applicable, the legal basis is likewise consent (Article 6(1)(a) GDPR). The user may withdraw consent at any time, as described in Section 8 below, without affecting the lawfulness of processing carried out prior to withdrawal.

6. Retention Period
6.1. Personal data is retained for 3 (three) years from the date the inquiry is received or from the date of the last contact with the user, including cases where the data is used to inform the user about new courses or to confirm their interest in future participation.
6.2. Data is deleted upon expiry of the above period or upon withdrawal of consent by the data subject, whichever occurs first, unless a longer retention period is required by applicable law.

7. International Data Transfers
7.1. Personal data is stored and processed on infrastructure accessible to the Operator, without deliberate transfer to third countries.
7.2. Should any transfer of personal data outside Kazakhstan become necessary (e.g., through a third-party service provider), the Operator will ensure such transfer complies with the requirements of RK law and, where GDPR applies to the data subject, with Chapter V of the GDPR (e.g., adequacy decisions or appropriate safeguards).

8. Data Subject Rights
Depending on the applicable framework, the data subject has the right to:
  • obtain confirmation of, and access to, their personal data and information on how it is processed;
  • request rectification of inaccurate or incomplete data;
  • request erasure of their data ("right to be forgotten" under GDPR; right to demand destruction under RK law) where it is inaccurate, outdated, unlawfully obtained, or no longer necessary for the purposes it was collected;
  • restrict or object to processing, including processing for informing about new courses;
  • withdraw consent at any time, with effect for the future;
  • where GDPR applies: request data portability, and lodge a complaint with a supervisory authority in their jurisdiction;
  • under RK law: lodge a complaint with the authorized body for personal data protection of the Republic of Kazakhstan.

9. Data Sharing with Third Parties
9.1. The Operator does not share personal data with third parties, except:
  • with the data subject's explicit written consent; or
  • upon a lawful request from an authorized government body acting within its competence.
9.2. The Operator does not sell or rent personal data to any third party for marketing or other commercial purposes.

10. Security Measures
The Operator implements reasonable organizational and technical measures to protect personal data against unauthorized access, alteration, disclosure, or destruction, including restricting access to data to personnel who require it to perform their duties.

11. Changes to This Policy
The Operator may update this Policy from time to time. The current version is always published on the Website at https://en.azgeology.kz/policy. Material changes affecting the scope or purposes of processing will be additionally communicated to users where feasible.
